1. Services & scope
CaiBrands LLC (Designer) will produce one custom-designed email newsletter for Kennedi Solomon (Client) using the written content, brand assets, and creative direction Client supplies. The $150 service covers one newsletter design. Email-platform setup, campaign sending, list management, automations, advanced HTML coding, additional newsletters, copywriting, and editable working files are not included unless separately agreed in writing.
2. Project price
The fee for this single email newsletter design is $150.00 USD. Payment is due according to the invoice or booking arrangement. Any additional deliverable, major redesign, or change in scope requires written agreement on the additional charge before that work begins.
3. All sales final & refund policy
All sales are final to the extent allowed by applicable law. Once Designer begins working on the project, the payment is nonrefundable. A change of mind, change of plans, or personal dislike of the design or creative style alone does not entitle Client to a refund. Client may communicate specific concerns and seek revisions within the agreed project scope. Nothing in this section limits remedies that cannot legally be waived, including remedies for failure to provide the agreed service.
4. Alternative service exchange
At Designer’s discretion, Client may request an exchange of any eligible, unused project value toward another CaiBrands service instead of a refund. A service exchange is not automatic; it must be requested and approved in writing, is subject to availability and pricing, and may require payment of a difference. Work already performed may reduce the eligible credit. Unused credit is not redeemable for cash except as required by applicable law.
5. Design direction & revisions
Client will provide sufficiently detailed direction, content and references before design begins. Designer may exercise reasonable creative judgment. Changes consistent with the original brief may be considered within the revision allowance separately confirmed in writing. A completely new concept, substantial content replacement, or additional formats may involve a new fee and schedule. Client is responsible for reviewing and proofreading all final content before approving it.
6. Scheduling & delays
The production timeline begins only after the agreement is accepted, any required payment is made, and all necessary material is received. No fixed delivery date is guaranteed by this form; Designer will confirm scheduling directly. Missing information, inaccessible asset links, late responses, and requested scope changes can extend the timeline.
7. Content, ownership & use
Client represents that they have rights or permission to use the supplied text, logos, images and promotional claims. Client is responsible for the accuracy and compliance of marketing statements, subscriber lists and offers. Upon full payment, Client may use the approved final newsletter design for its intended business purpose, subject to third-party licenses. Designer does not guarantee sales, clicks, open rates, inbox delivery, or email-platform performance.
8. Communication & electronic acceptance
Both parties agree to address project concerns in good faith and confirm scope changes in writing. By typing their full name in the cursive signature field, checking the agreement boxes, and submitting the form, Client indicates their intent to sign this agreement electronically and agrees to its terms. Electronic acceptance and submission records may be retained as documentation.
